HC allows conditional release of 'Nenjirukkum Varai'

The Madras High Court has allowed the release of "Nenjirukkum Varai", directed by S.A. Chandrasekhar, starring Naren and new face Deepa on condition that the producer furnish a bank guarantee for Rs.25, 000.

Justice Sudhakar passed the interim order on a petition from Aby Kunjumon, son of the producer of "Gentleman" and "Kadalan", alleging that Baba's production "Nenjirukkum Varai" was an infringement of the Copywrites Act as its climax and some other portions of the story were copied from "Swasam" being produced by Kunjumon and director Balaji. The story of "Swasam" was registered with South India Story Writers Association on Aug.14, 2000.

'Swasam' is a love triangle. Two women love the hero, a poor man who works hard to come up in life. The hero loves only one of them. The woman, whose love is spurned by the hero, offers to donate her heart to save the life of her lover (the hero) who is fighting for his life after being injured in an accident.

Kunjumon himself plays the hero in "Swasam" directed by Balaji. The cast includes Priyanka, Sridevi, Sindhu, Sarathbabu, Jothi and Nagesh. Akash is the music director. Due to financial problems, they had to suspend the shooting halfway through and now the shooting has resumed.

In the meantime, "Baba" produced "Nenjirukkum Varai" under the direction of S.A. Chandrasekhar. The story was reportedly written by Shoba Chandrasekhar. This film was scheduled to be released on Dec.15.

Kunjumon in his petition stated that the storyline and the climax of "Nenjirukkum Varai" were copied from "Swasam" in violation of the Copywrites Act and prayed for staying the release of "Nenjirukkum Varai"

The petition came up for hearing on Dec. 14 and Justice Sudhakar passed interim orders allowing the release of the film on condition that the producer furnish a bank guarantee for Rs.25,000 and directed the producer to file his counter the next day (Dec.15).
